Electronic Records & Signatures Consent

1. Purpose

This E-Sign Consent ("E-Consent") explains how The Local Loan Store ("we," "us," or "our") provides disclosures, notices, agreements, and other records ("Communications") to you electronically, and how you may sign documents electronically, in connection with our website, inquiry forms, loan applications, and servicing — whether you are in an urban neighborhood or a rural community. By providing your consent below, you agree that any Communications we provide electronically have the same legal effect as if provided on paper.

2. Scope of consent

Your consent applies to all Communications we (or our service providers) may provide or make available to you in connection with:

  • Your inquiry, pre-qualification, or loan application;
  • Required federal and state disclosures (including TILA, RESPA, ECOA, GLBA, and state-specific notices);
  • Loan estimates, closing disclosures, promissory notes, security instruments, and other loan documents;
  • Servicing, billing, payment, escrow, insurance, tax, and default-related communications;
  • Privacy notices and changes to our terms;
  • Customer service messages and responses to your inquiries.

3. Method of delivery

We may deliver Communications by: (a) email to the address you provide; (b) posting them in a secure online portal and notifying you that they are available; (c) text message where you have consented; or (d) any other electronic means permitted by law. You agree to keep your contact information current.

4. Hardware and software requirements

To access, view, retain, and print Communications you will need:

  • A computer, tablet, or smartphone with internet access;
  • A current version of a major web browser (Chrome, Edge, Safari, or Firefox);
  • An active email account capable of receiving messages with PDF attachments;
  • Software capable of displaying PDF documents (e.g., Adobe Acrobat Reader);
  • Sufficient electronic storage to retain Communications, or a printer to print them;
  • A device capable of supporting 128-bit encryption.

If our requirements change in a way that creates a material risk that you will not be able to access or retain Communications, we will notify you and give you the right to withdraw consent without fee.

5. Paper copies

You may request a paper copy of any Communication we have provided to you electronically by contacting us at the address below. We may charge a reasonable fee for paper copies as permitted by law, except for documents we are required to provide on paper.

6. Withdrawing consent

You may withdraw your consent to receive Communications electronically at any time by emailing econsent@locallloan.example or by writing to us at the address in Section 9. Withdrawal will be effective after we have a reasonable opportunity to act on your request. Withdrawing consent does not affect the legal validity or enforceability of Communications previously provided electronically. If you withdraw consent, we may not be able to continue offering certain online services or may need to terminate your application.

7. Updating contact information

You agree to promptly notify us of any change to your email address, phone number, or mailing address by updating your account, calling us, or emailing monumentalfundingsolutions@gmail.com. We are not responsible for Communications you do not receive due to outdated contact information.

8. Use of electronic signatures

You agree that any electronic signature you apply (including by typing your name, clicking an "I Agree" button, or using a third-party signing service such as DocuSign, Dropbox Sign, or similar) has the same legal force and effect as a handwritten signature, and that electronic records satisfy any law requiring a writing. This consent is given under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) and applicable state law (including the Uniform Electronic Transactions Act).

9. Confirming your ability to receive electronic Communications

By submitting our online inquiry form, creating an account, or otherwise affirmatively indicating agreement, you confirm that: (a) you can access and read this E-Consent in the format presented; (b) you can access, view, retain, and print Communications delivered electronically; (c) you consent to receive Communications and sign documents electronically as described above; and (d) the email address and other contact information you have provided are accurate and current.
